Abstract

This work is part of an ongoing research, whose object of study is the Toy Library in a hospital environment. It aims to present the first legal discussions on the subject. In observation of the latest movements in the world, there is a concern with the student when he is being treated in a hospital environment. It is justified due to the concern generated when discussing childhood traumas during the hospitalization process, impairing their cognitive development, as well as bringing harmful reflexes to their physical and psychological recovery. This can have negative consequences on their development. And, with the purpose of minimizing this situation, we will carry out a bibliographic survey based on observation of compliance with the prescriptions provided for in current legal documents, such as the Federal Constitution of Brazil, the Law of Guidelines and Bases of National Education register the concern for the equity of education, seeking in Special Education, a more humanized service that will be fulfilled in classes, schools or specialized care. With the sanction of Law 11.104/2005, obliging Brazilian hospitals specialized in child care, the implementation of children's spaces, bringing to the child's life, materials and games fundamental for child development, evidencing their impacts on the recovery of the student-patient. It is understood that nowadays, the importance of the act of playing in the social and cognitive development of the child can come to minimize these discomforts, serving as a tool for therapeutic purposes. Effectively, new legislation brought changes, presented improvements in educational services.
