FREEDOM OF SELF-DETERMINATION: A PANORAMA OF EUTHANASIA IN BRAZILIAN LAW IN THE LIGHT OF IMMANUEL KANT
Abstract
Using the deductive approach method and the bibliographic research technique, as well as the analysis of jurisprudence, this article aims to discuss the freedom of self-determination in 21st century Brazil in the light of the current legal system and the theory of justice proposed by Immanuel Kant. To this end, it analyzes the judicial and legislative panorama of euthanasia in Brazil, in order to demonstrate that the recognition of the fundamental right to a dignified death as a means of consecrating the dignity of the human person is not far from becoming a reality, even more considering the achievements obtained in relation to abortion and orthothanasia, which showed a tendency to make the right to life more flexible when confronted with the freedom of self-determination. In this sense, it is sought to conclude that, despite the several obstacles still imposed on the free development of personality, the Brazilian State has been giving individuals an increasing sphere of freedom so that each one can develop his personality, find happiness, and achieve their own ends, free from external impediments. Thus, Law has been gradually moving towards achieving the ultimate goal proposed by Immanuel Kant: the realization of justice through freedom as a non-impediment, that is, as the faculty of external action not limited by the other.
