Abstract

This article seeks to discuss the historical evolution of human rights and its positivation, analyzing the great current challenge of obtaining the effective guarantee of human rights, in order to effectively curb all violations of such fundamental rights, which they can´´´ not be tolerated by the national legal system, as well as international.
