RIGHT TO EDUCATION AND JUDICIAL POSITION: DEMANDS FROM STUDENTS WITH AUTISTIC SPECTRUM DISORDER (ASD)

The right to education for autistic students is often hampered/impossible by schools. The aim is to generate demands from the Judiciary for the most varied needs of these students. In view of this, this research is dedicated to the analysis of rulings handed down by the Court of Justice of the State of Rio Grande do Sul, to verify the position adopted by the Judiciary that does not concern the right to education of students with autism spectrum disorders ( ASD) in basic education. This study presents readers with a reading organized into chapters, in the first theoretical chapter. a presentation was made on the right to non-discrimination and inclusion. . Later, in the next chapter, the reader is referred, specifically, to the right to education for autistic students, with considerations from academics and national and international legislation. Next, judgments are analyzed to verify existing demands, and the position of the RS Judiciary, precisely, in TJ/RS judgments, in order to answer the research question: considering judgments from the RS Court of Justice, what position is adopted by Is the Judiciary not concerned with guaranteeing the right to education for students with a version of the autism spectrum (ASD) in basic education? This will make it possible to understand how the right to education is guaranteed to you, students.
