FAKE NEWS IN THE BRAZILIAN CONTEXT
AN ANALYSIS OF THE EFFICACY OF LEGAL AND POLITICAL-INSTITUTIONAL MECHANISMS IN COMBATING THE PROLIFERATION OF FAKE NEWS

This work focuses on a context of constant dissemination of fake news and, consequently, attacks on democracy. It aims to investigate the existing legal and political-institutional instruments in Brazil and their capacity to effectively curb the phenomenon of fake news. It uses a deductive approach and bibliographic and documentary procedures. As a result, it concludes that the Brazilian legal system still lacks specific legislation on the subject and that Bill N. 2,360/2020, while important, does not resolve the problem as a whole. Regarding political-institutional instruments, examples were cited of the Federal Senate's initiative ("Senado Verifica: fato ou fake?") and the federal government's initiative, "Brazil against fake news." It was observed that, like legislation, institutional alternatives still require improvement. In this sense, to chart possibilities for a new horizon, the research proposed the creation of social platforms or cooperatives, so that networks can be more democratic and thus hinder the proliferation of fake news.
