Abstract
A Constituição Portuguesa de 1976 – a sexta lei magna de Portugal e que representa o novo Constitucionalismo Democrático e Social trazido pela Revolução dos Cravos de 25 de Abril de 1974 – apresenta como um dos seus pilares fundamentais o sistema de direitos fundamentais, no qual são evidentes mudanças profundas não apenas numa conceção pluralista e aberta do catálogo dos direitos fundamentais positivado como também na efetividade da sua proteção jurídica contra a subversão que muitas vezes os poderes infraconstitucionais tentam operar no sentido de boicotar a sua realização prática.
