DIREITOS HUMANOS FUNDAMENTAIS DAS PESSOAS COM DEFICIÊNCIA
Abstract
Este artigo versa sobre os direitos humanos fundamentais das pessoas com deficiência, sob a perspectiva do processo de dinamogenesis de direitos. Por se tratar de um estudo descritivo e exploratório, será realizado com base na pesquisa bibliográfica e histórica, utilizando-se por vezes do método dedutivo e, outras vezes, do indutivo, principalmente nas críticas e reflexões acerca dos textos normativos. A terminologia “direitos humanos fundamentais” se justifica na ideia de complementariedade entre as tutelas nacional, regional e universal desses direitos, constatado o fato de que há direitos humanos que são constitucionalizados e direitos humanos fundamentais que são internacionalizados, podendo-se afirmar a primazia dos direitos humanos fundamentais, tanto no âmbito nacional quanto no internacional. Nesse sentido, este artigo analisa a tutela jurídica das pessoas com deficiência em três níveis: internacional, regional e nacional, traçando um diálogo entre os níveis de proteção, à luz da teoria do Estado Constitucional Cooperativo, de Peter Häberle.
