O NOVO CONSTITUCIONALISMO LATINO-AMERICANO E SABERES TRADICIONAIS: DIGRESSÕES DESDE A PLUNACIONALIDADE PARA NOVAS PERSPECTIVAS DE SALVAGUARDA DOS DIREITOS HUMANOS INTERGERACIONAIS
Abstract
A presente pesquisa objetiva analisar possíveis formas de tutela efetiva aos saberes tradicionais e biodiversidade associada a partir dos preceitos e fundamentos do novo constitucionalismo latino-americano, enquanto movimento regional capaz de aproximar regionalmente os pensamentos acerca dos valores universais de acordo com a identidade e necessidades próprias do continente. Parte-se da seguinte problemática: Quais os limites e possibilidades para que o novo constitucionalismo latino-americano seja capaz de confrontar os imperativos econômicos globais, com vistas à tutela efetiva da sociobiodiversidade e, por consequência, dos direitos humanos intergeracionais relacionados à vida e ao meio ambiente ecologicamente equilibrado? Para responder, metodologicamente utiliza-se a perspectiva sistêmica. Como procedimento e técnica, a pesquisa bibliográfica e construção de resumos e fichamentos. Como resultado pode-se inferir de forma inicial que a plurinacionalidade pode contribuir para os diálogos acerca na necessidade de criação de um instrumento jurídico-político para tutela efetiva dos saberes tradicionais e biodiversidade associada, e, portanto, dos direitos humanos intergeracionais.
