O IMPACTO DO TERRORISMO NOS DIREITOS HUMANOS: UMA ANÁLISE CRÍTICA DAS MEDIDAS INTERNACIONAIS DE COMBATE AO TERRORISMO À LUZ DOS DIREITOS HUMANOS
Abstract
Atualmente é possível dizer que já se abandonaram as teses de que a proteção dos Direitos Humanos não passava de um problema ou assunto puramente interno, pois as normas que visam à proteção internacional de direitos humanos são um claro reflexo desta contemporânea linha de pensamento. Nesse cenário, a ONU se apresenta como o principal responsável pela efetiva proteção desses direitos, que vem sofrendo com os diversos ataques terroristas perpetrados mundialmente. No seu papel de efetivador dos direitos fundamentais dos indivíduos, a ONU acaba por adotar ações e medidas que podem, por si, ferir os próprios direitos que a Organização visava proteger. A presente pesquisa busca demonstrar, destarte, o paradoxo existente no emprego das medidas extremas de combate ao terrorismo, nomeadamente das Resoluções 1267 e 1373, que foram adotadas pela Organização com o objetivo de permitir o combate ao terrorismo em âmbito global por meio das chamadas smart sanctions. Para tanto a pesquisa irá abordar a internacionalização dos direitos humanos, bem como o impacto que os atos terroristas podem ter sobre estes direitos. Apresentando, por fim, o paradoxo na aplicação dessas medidas, quando tomadas de maneira extrema e sem a devida observância dos direitos humanos.
