THE FUTURE OF THE LAW AND STATE IN THE INFORMATION SOCIETY.
Abstract
This article analyzes the transformations of Law and the State in the Information Society. The popularization of the internet and internal networks has automated procedures and connected global markets in real time. When networking is an economic imperative, connection becomes a fundamental right. In companies, the distribution of gadgets to employees brings to light the “right to disconnect”. At the State level, administration, the legislative process and jurisdiction are rethought in view of the speed of technological advances that multiplies and diversifies demands and conflicts. In this context, the problem faced by the article is how the Law can respond to the demands of rights at the speed at which they happen. The systematic interpretation among generic laws; general principles on the network society; classic laws over conducts in the physical world, and the use of analogy, emerge as a solution for the jurisdiction and State regulation over relationships born in the digital environment.
