O “CABO DE GUERRA” DA REGULAMENTAÇÃO DO NOVO FUNDEB
Abstract
In 2020, the right to education was the subject of an important agenda in the Congress: the approval of “New Fundeb” (EC. 108/2020) and its regulamentation. This article aims to discuss, from the perspective of law and public policies, based on a descriptive analysis, the process of approval of the constitutional amendment to the Brazilian Constitution, comparing the processes of transition of the funds, as well as the analysis of the movement of politicians and those involved in the construction of the “New Fundeb” regulation text, demonstrating the government and parliamentary expedients of political movement in the legislative process, the expedients used both for the approval of Amendments to the Constitution, as well as for its regulation, in order to understand the role of political agents and the strategies used to realize the right to education.
