A PANDEMIA DE COVID-19 E A VULNERABILIDADE DOS IDOSOS: O UTILITARISMO NA SAÚDE
Abstract
This article aims to reflect on the influence of utilitarian theory in ethical decisions taken during the pandemic of COVID-19 and how these decisions reflected on the effectiveness of the right to health of the elderly, aggravating the vulnerability of this group. The central object of the research is the utilitarian theory, its impacts on decisions regarding the rationing of beds and equipment during the COVID-19 pandemic and the violations to the right to health of the elderly, a group extremely affected during the pandemic caused by the new Coronavirus. The expected results are about reflecting in which way the decisions taken in the health area, considered as ethical, have a utilitarian nature, which will be achieved through a methodology that makes use of bibliographic and documental research, bringing doctrines, legislations, documents and qualified periodicals, both national and foreign. The research is justified because of the relevance of the topics addressed, among which stand out: the COVID-19 pandemic, sanitarianism, vulnerability, the social right to health, the utilitarian theory and the effectiveness of the fundamental right to health, the latter analyzed from the protection of the elderly by the legal system.
