THE CRIMINALIZATION OF LGBTPHOBIA BY THE BRAZILIAN SUPREME COURT
Abstract
The purpose of this study is to provide critical information about the decision handed down by the Brazilian Supreme Court on June 13, 2019, subsuming discriminatory conducts based on sexual orientation and queer theory to the provisions of Law 7.716/89. Disagrees with the criminalization of conduct being established by the judiciary, in violation of the principle of legal reserve, nor are several of the arguments used to base the decision.
