Revisitando Foucault: os corpos das mulheres, o biopoder e a questão do aborto

Abstract

The criminalization of abortion in the Brazilian penal system goes against the fundamental human rights that, in theory, serve as the basis for our legal system. Viewed under a controversial and refutable veil, themes like the right to life, the voluntary interruption of pregnancy, the woman's freedom of choices that envolve her own body and public health as a cover for all the others, these are still coated with religious perceptions and traditionalists who are no longer convenient in the face of our reality, intentions, globalization, normative principles bases and (neo)liberalism, if not those who support those who turn up their noses in the face of the issues. The present work is intended to demonstrate the serious social asymmetries that the criminalization of the practice of abortion, which is and has always been common in our society, causes social and legal scenes, initially passing through the study of biopower and biopolitics, which has large theoretical importance, as they are the mechanism of population control acting directly on the particular body of each citizen, whether male or female, and which brings to the debate issues such as those initially explained. Finally, the construction of speeches about the truth acting of micro-powers in women's autonomy, freedom and life, confronting with fundamental rights. The research used the deductive method and the qualitative approach, as well as bibliographical and documentary research techniques.
